上海應(yīng)用技術(shù)學(xué)院基本建設(shè)合同管理辦法細(xì)則（暫行）

normal style=line-height: 150%; text-indent: 32pt; margin: 0cm 0cm 0pt; mso-char-indent-count: 2.0>上海應(yīng)用技術(shù)學(xué)院基本建設(shè)合同管理辦法，必須以《中華人民共和國(guó)民法通則》、《中華人民共和國(guó)合同法》、《中華人民共和國(guó)建筑法》等有關(guān)法律法規(guī)為依據(jù)。結(jié)合《上海應(yīng)用技術(shù)學(xué)院合同管理暫行辦法》和基本建設(shè)工程實(shí)際，制定本細(xì)則。

normal style=line-height: 150%; text-indent: 32.15pt; margin: 0cm 0cm 0pt; mso-char-indent-count: 2.0>一、合同簽訂原則必須遵守國(guó)家法律、法規(guī)，堅(jiān)持平等互利、協(xié)商一致、誠(chéng)實(shí)守信，維護(hù)學(xué)校的合法權(quán)益。

合同”是指上海應(yīng)用技術(shù)學(xué)院法人授權(quán)委托人在學(xué)?；窘ㄔO(shè)工程中為明確雙方的民事權(quán)利、義務(wù)關(guān)系所訂立的書(shū)面協(xié)議，包括：工程勘察、工程設(shè)計(jì)、工程施工、工程監(jiān)理、材料設(shè)備采購(gòu)、技術(shù)咨詢(xún)、服務(wù)（不含投資監(jiān)理、財(cái)務(wù)監(jiān)理）等與基本建設(shè)工程相關(guān)的合同、協(xié)議、備忘錄、確認(rèn)書(shū)等。

normal style=line-height: 150%; text-indent: 32pt; margin: 0cm 0cm 0pt; mso-char-indent-count: 2.0>三、依據(jù)基本建設(shè)資金來(lái)源的性質(zhì)合同分類(lèi)為：含有市財(cái)政經(jīng)費(fèi)的基本建設(shè)合同、學(xué)校自籌資金的基本建設(shè)合同，按照統(tǒng)一的流程進(jìn)行審批管理。

基建處起草管理、部門(mén)審核監(jiān)督、主管校長(zhǎng)審批簽署”的制度；合同的審批程序：由基建處負(fù)責(zé)起草，經(jīng)審計(jì)處、監(jiān)察處、財(cái)務(wù)處審核，報(bào)分管校長(zhǎng)審批、簽署后，由基建處加蓋合同專(zhuān)用章并保管。具體職責(zé)：

normal style=text-align: left; line-height: 150%; text-indent: 32pt; margin: 0cm 0cm 0pt; mso-pagination: widow-orphan; mso-char-indent-count: 2.0; tab-stops: list 68.25pt left 84.0pt list 105.0pt left 126.0pt>3、財(cái)務(wù)處負(fù)責(zé)對(duì)合同所涉及的財(cái)務(wù)核算結(jié)算是否符合國(guó)家和學(xué)校財(cái)務(wù)制度，對(duì)合同簽訂和履行全過(guò)程的資金計(jì)劃、合同金額、結(jié)算、收付款方式及時(shí)間節(jié)點(diǎn)等進(jìn)行審核。

normal style=line-height: 150%; text-indent: 24pt; margin: 0cm 0cm 0pt; mso-char-indent-count: 1.5>（四）合同內(nèi)容經(jīng)審核需要修改的，由基建處負(fù)責(zé)修改，必要時(shí)可以組織合同乙方、學(xué)校相關(guān)部門(mén)進(jìn)行商務(wù)談判，有重大變更的需經(jīng)學(xué)校同意后方可進(jìn)行合同修改，并按照以上程序重新流轉(zhuǎn)、審核、會(huì)簽。

上海應(yīng)用技術(shù)學(xué)院基本建設(shè)工程合同審核流轉(zhuǎn)表（以下簡(jiǎn)稱(chēng)：流轉(zhuǎn)表）”的形式會(huì)簽，相應(yīng)的附件按照招投標(biāo)的形式不同分別為：

流轉(zhuǎn)表”形式審核、會(huì)簽；

流轉(zhuǎn)表”必須附邀請(qǐng)依據(jù)、被邀請(qǐng)單位的合同報(bào)價(jià)單、投資監(jiān)理的合同價(jià)格審核意見(jiàn)單；

流轉(zhuǎn)表”必須附學(xué)校批復(fù)的項(xiàng)目立項(xiàng)依據(jù)、邀請(qǐng)依據(jù)、被邀請(qǐng)單位的合同報(bào)價(jià)單、投資監(jiān)理的合同價(jià)格審核意見(jiàn)單。

normal style=line-height: 150%; text-indent: 40pt; margin: 0cm 0cm 0pt; mso-char-indent-count: 2.5>1、依法訂立的基本建設(shè)合同，不得擅自變更或者解除，確因情況出現(xiàn)較大變化或出現(xiàn)不可抗力因素，需要變更或解除的，由基建處報(bào)學(xué)校批準(zhǔn)，同意后按以上合同流轉(zhuǎn)程序辦理補(bǔ)充合同。
